Wife of Robert F Kennedy Jr Arrested for Drunk Driving

Mary Richardson Kennedy, wife of RFK Jr., was arrested for drunken driving in Bedford, New York on May 18th.

Police officers charged Kennedy with a DUI when they saw her run over a curb outside a school. Sgt Matthew Dunn said that Kennedy’s blood alcohol level was a .11.  New York state’s legal limit is .08.

Bedford is approximately an hour north of New York City.  Robert Kennedy’s spokeperson has not made any comments at the time of this writing.

During the presidential election, a television ad ran in Ohio during the month of August in favor of John McCain used a snippet of Jackson Browne’s song “Running on Empty”, and Browne sued John McCain, the Republican National Committee and the Ohio Repubican Party for copyright infringement.

Now, McCain’s lawyers have struck back with legal filing including comments saying that “given the
political, non-commercial, public interest and transformative nature of the use of a long-ago published song, the miniscule amount used and the lack of any effect on the market [his] claims are barred by the fair use doctrine” and further that the “claim is barred as a matter of law because the Lanham Act does not apply to political speech.”

Should the court rule in McCain’s favor, it could establish a precedent which would make it much harder for songwriters to complain if/when political parties use their songs without permission.

Eliot Spitzer Avoids Criminal Charges

Disgraced New York governor Eliot Spitzer, who resigned back in March when he was discovered to be using a call girl service, won’t be needing a criminal defense attorney.

The US Attorney assigned to Spitzer’s case says that there is no evidence that Spitzer spent anything other than his own money in hiring Ashley Dupre among other call girls, and will not be criminally charged.  It was originally thought that Spitzer may have been siphoning funds from the state in order to pay the bill.  He will additionally not be charged as a “john” for using the prostitution services.

Sarah Palin’s Wardrobe Defense Costs Consignment Store Their Name

When the story exploded that the RNC spent $150,000 on Sarah Palin’s wardrobe, Palin rebutted saying that her wardrobe comes from her favorite consignment store in Anchorage, Out of the Closet.

Well, it turns out that there is a non-profit chain of stores in California and Florida which is also called Out of the Closet.  When the AIDS Healthcare Foundation found out about the the AK store, the sent a copyright infringement cease and desist letter to the owner asking them to change their name.

Ellen Arvold, who owns the store in Anchorage, has said that she will comply and change the name.  No word if this has affected who she may vote for on November 4th.
